The family of the mentally ill homeless man who was shot and killed by two Albuquerque officers is planning to file a wrongful death lawsuit against the police department.
On Tuesday, the Kennedy Law Firm sent a letter to Mayor Richard Berry and APD Chief Gorden Eden of their intent to file a wrongful death lawsuit on behalf of James Boyd's surviving family members.
Boyd's brother, Andrew Jones, filed a court order to be appointed as the "personal representative" for Boyd. This gives Jones the legal right to investigate, pursue and resolve any wrongful death claim.
APD officers Keith Sandy and Dominique Perez shot Boyd after a confrontation in the Sandia foothills nearly two months ago. Lapel camera video of the incident went viral online, sparking several protests and demands for reform of the Albuquerque Police Department.
